Sir,
We, my mother,myself,my brother& my married sister are going to effect partition of our family properties. My mother is staying with my brother and wanted to give her share to my brother & we all agreed. But despite advice by other senior relatives to allow my brother to take it after my mother"s time, my mother insists to give all her share without any condition now itself.
Now the question is
1. If my brother fails due to any reason to look after my mother after taking her share of property, will myself & sister are liable for paying her maintenance.
2. Who will provide maintenance after my brother's time? His family?
We are going to prepare a family settlement document. Kindly advise how to incorporate this issue & what type of clause has to be mentioned.

Sir I would just like to advise your mother not to give property to anyone. In this mindset none of her is going to care for her

Answer: Yes.
2. Who will provide maintenance after my brother's time? His family?
Answer: All her sons and daughters.(She can claim from any.) after them their family.
Suggestion:
Your mother should execute will in favor of the person she want to give her property after her.
