Issues to be framed

Hi Sirs,
We are defending a civil suit pending in lower court, it was filed in 2012 and more than dozen instances of case being listed for issues to be framed. Yet we have not seen this case go beyond this state.
When we check with our lawyer, he informed that it is duty of assigned judge to take this up. But since we are not aware how we can call upon the court to take this up to allow us to further move the case into next state or provide us suitable solution.
Seek advice how we should proceed as we are not sure of next steps.

On the next listed date your lawyer should orally request the court to frame issues.It is true that framing issues is business of court but it is not so that a party or his lawyer cannot remind the court when there are dates and dates for same purpose .

Submit the draft of proposed issues in court and request to court to finalise the same.

It is the civil matter. It takes its own time, unless your advocate frequently makes mention in the court.

Framing of issues in civil suit will depend upon the burden of pending cases for the purpose in the said courts, this includes other practical constraints too, however, your lawyer can insist on the subject during next hearing.
