Marking of defense documents

Ld Counsels,

What is the right time for making of defense documents. Is it mandatory to mark the defense document prior to cross examination of witnesses.

Please clarify. Thanks.

In your evidence documents can be marked. You can confront the documents while cross examining the wittnesses, those documents will be marked

If you are plaintiff then those documents will be marked in P series . If you are defendant then they will be marked in D series.

In the civil case the deft has to produce all the documents which he is relying upon, along with the written statement itself. Then mere deferring to mark the same does not make any sense.

documents in defence are marked while deposing the evidence of the defence witnesses and not prior to that. This means the documents are to be mentioned during the course of evidence in chief and not prior to that.

The documents are to be mentioned during the course of evidence in chief but those which do not require any formal proof can be marked at once.
