Will

(Querist) 23 January 2012 This query is : Resolved 
My father signed a will(not registred) for House which was alloted to him from l&do in delhi, now he has expired. He has given right to my mother to stay in the house till she alive, in this case, can I submit the will for probate or not.

My second question is can I write a will for the same House in my son name at present because life is uncertain?

If he is no more than to take effect of the Will, Probate needs to be granted.

Yes before getting the Probate, you can execute Will with respect to the property you got through that Will.

You are advised to make your will only after probate is granted.

since your mother has been granted life interest in property get probate of will done . in the meantime you can make your will in respect of said property .

you can not make will on the entire property..

if you are only one legal heir mean its ok.. otherwise other legal heirs also will get share.,

Probate can be obtained even just now.
You can also make your will just now even before probate but it shall be ineffective till life of your mother or till you are alive whichever is latter.

My mother and sister's are not signing the noc in my favour from the last 5 months I, my wife and son who is 23 years old are living with my mother, at my faher house now my mother is interested to distribute the house in 5 shares 3 sister one for herself and one for me but my father unregistered will read like this after the death of my wife my son will be the absolute owner of house and he has full right, title and interest in the aforesaid house to deal with same as he likes. Neither my daughter nor anybody also has any right to raise obhjection.
My mother playing lot of tactics so that we vacate our father house.

Now I want to know if she (my mother) and my sisters and my brother in law can force us to vaccate the house.

And for the safety of my faimly what stand I should take to live in my house peacefully with my mother.

I was mentally harassed by mother words.

Is it possible to stop my sister's

interfereance in my family. My mother say if you won't vacate the house I will make a complaint against you in Senior Citizen bureau.
