based on my five cr from 2005 to 2010 my cr report for 2005 was average, iam the senior most person as per south zone seniority list. In 2005 i have given minor punishment (cutting one increment) and my cr report of 2005 was not properly communicated to me.at that time i was a godown incharge and the cwc management without my knowledge / with out my delivery notice issued to them. they has disposed the misc (sweepings and droppings cotton) and that was not properly find out by me as it was not in our stock books maintained and no line incharge or higher official noted in their tour report or maintained my earlier godown incharge. the stock inward only taken at the time of dispose by auction, so based on not proper record maintaining i have given punishment (in ap). this was the first time our ho asked the cr for five years and some of our junior staff working in accounts section promoted even they are having less service 3 years only (newly recruited) i have made a request to our ho to consider my case sympathetically based on my long service but not succedeed. Iam working as Junior Assistant In the public sector undertaking "The Cotton Corporation of India Limited", I have already punished and the punishment was one increment cutting was over and given 2006, DPC at ho office has not considered and stopping of promotion gave me huge pain of double punishment, can i will get promotion if i was legally approched and have a justice for getting promotion

repeated query.. When below bench mark report was conveyed. Have you made representation against it when conveyed?
What eexatly is the penalty? Ther eis no penalty of cutting the increment it is either stoppage of increment or reduction of pay ? When was it awarded? when was next increment due? How many increments hve been stopped? If it is reduction of pay then it is for how much period?

the punishment was withholding of increment for one year. as per recent full madurai bench comprising chief justice m.y. eqbal and other justices 2009 in dtd:28/04/2011 declared that it was needless to state that after the currency of the punishment period, a government servant was entitled to be considered for promotion, if otherwise eligible (please see the web site published in hindu - http://www.thehindu.com/2011/0428/stories/2011042865780500.htm i.e., as per rule 8 and the administrative instructions under article 309, 162 of constitution. I also raised a request to our ho (cci) that to expunge my remark of 2005 as it was not properly intimated to me well in time or give me promotion on seeing my seniority and my service rendered in the organization is of 11 years may be kindly considered as the other employees who promoted with 3 years seniority is not good. In one organization the rule is one & equal to all category of employees and so they should promote the staff if they complete the 5 years service period as they should also have five years CR good report. Stopping of my promotion is not good and as on date they should at least consider to give me promotion. There is no law to punish the person for two times for the same mistake where it was not a mistake done by me, making of required documents and records maintaining is a procedure of the organization and should be properly guided to the new member of posting. Where as in my case I was the Office (General) staff and is placed in the field work where the work is handled by the trained field staff only due to over work management posted me to field work where my knowledge is little and managed as per the earlier procedure maintained usually at that place and no body or higher official instructed to specifically.
I am having great confidence i will succeed in this case
