Passport issue while dv case pending

Hi All,

Would any help me in such matter, my wife file a DV case against me which is still pending before court. And I got a chance to visit abroad for short period through my private company, but unluckily my passport is expired and I need to renew it. There is a clause in passport application "Have you ever been charged with criminal proceedings or any arrest warrant/ summon pending
before a court of India?"

What to answer it "Yes" or "No"

If I answer yes then passport office will not issue passport.

Please give me guidance to tackle such situation.

Criminal proceedings are pending against you, do not hide the fact otherwise it may result in troubles.
