though the query was repeated in another thread, where other opinions have also been seen, expert Mr. Shroff has given his opinion with regard to the settlement before court, but full fee also can be refunded by court is settlement is through lok adalat.

1.yes, u can ask for refund of court fee from court.
2. file application u/s 151 of cpc for refund of court fee in court.

Was your suit proceeded i.e., issuance of process to defendant, marking attandance within stipulated period, rejection or allowing leave to defend so on and so forth? If yes, court fees paid can be refunded after proportionate deduction of the proceedings. However, if the suit has been settled in mediation or counselling etc. (Section 89 CPC)you can get full refund of court fees paid u/s 16 of Court Fees Act.
