This query is : Resolved
If a person has filed for probation and his application has been rejected by the Supreme Court, then can he file an application for probation again (may/maynot be on same grounds)? Also, are there any case laws related to the same. Kindly help.

Ok sir! If not the case laws.... can I just get to know whether one can repeatedly apply for probation applications? Like if it has been rejected in the first go can one apply for the same again?

No. He cannot file such application on the same ground, however, if strong ground other than already pleaded, is inserted then such application can definitely be moved.

application for probate on the same grounds will be rejected under the resjudicata provisions. Thus, see if there can be any different reason that can be inserted in the fresh application and a pleading and prayer based on the newly added ground, the application may be taken on file by the court. Try.
