Penalty issue

Respected Sir,
If plantiff is not apeeared on the date of hearing.. the penalty which is charged by court to plantiff is to be given to defendant or the advocate of defendant..?

The court is having the discretion of ordering penalty:-

1. the penalty can be payable to the other party.

2. the penalty can be payable to the legal aid center or any other forum.

If the cost awarded by the court is to be paid to the legal aid, it will go the legal aid or it will be paid to the advocate of the opposite party.
