Rental agreement

Dear Sir / Madam,

I have given my shop in Navi Mumbai, Maharashtra on rent for 3 yrs. Min lock in period was for 6 months. The registration of the agreement was not done but the police clearence was done.
I got my deposit by cheque and 1st month rent by cash and received the remaining 10 months rental cheques for the 1st year.
Its been 5 months now and all the cheques given have bounced.
The tenant does not take my calls, sometimes he answers my calls but fails to keep the promise of meeting me, whenever i go to the shop it is closed. He used to boast of knowing the local policemen in that area.
How can i get around this mess?

issue legal notice for eviction and for arrears of rent . if he refuses to vacate file eviction suit

After issuance of legal notice and refusal then go into eviction suit.

Send legal notice for bounced cheques and file suit u/s 138 NI Act.

Send notice for eviction of the shop and file suit.

Yes, both eviction suit and cheque bouncing case can be initiated.

My Lawyer has issued an eviction suit to the tenant. The tenant has not replied. Its been one and a half month since. Now we will be filing a eviction suit.
According to my lawyer i will be able to recover only my rental amount which is due to me, till the time he vacates the shop.
The filling of the case, lawyer's fees costs money.
Why can't the tenant be punished for harassment? Why can't the tenant be made to pay a penalty for defaulting in paying his monthly rent?
All i see is that i loose my time and money which is rightfully due to me. And the tenant peacefully occupying my shop and going about his regular business.
Is our Legal law so weak?
Need advise.
