(Querist) 12 July 2013 This query is : Resolved 
Plaintiff filed a permanent prohibitary injunction against the defendent not to tresspass in to the plaintiff schedule property and committ any wastes.The defendent is the wife of the original property owner who is away in abroad. Can the Civil court passed a permanant prohibitary injunction against the wife without impleading the husband of the defendant as a party in the suit

when you file injunction against defendant and his agent and relatives so no one interfer your suit property if you get injunction.

why did you make only the wife as party to the suit and not the husband ? if husband is abroad and not interfering with your possession it is not necessary to implead him as a party . contact a local lawyer .it is necessary to see the case papers and basis of which only wife is made a a party to the proceedings

Every person from whom you do think a danger to intervene should be impleaded as party to that suit. You can even now amend the suit.
