Open land tenancy

(Querist) 03 April 2013 This query is : Resolved 
As per Maharashtra Rent Act 2000 Sec. 7(9)
Premises means any building or part of a building let or given on licence but do not include open "Land". Thus this Act is not applicable to letting or sub-letting of land any longer. The transaction of letting of land would be governed by the Transfer of Property Act.
And now open land governed by tranfer of property act sec.106.
I will be obliged if any judgement passed by Hon.High Court or Supreme be given for the reference
