I am working in a bank as clerk. I given written test on 03/10/2010. I came to know that I have secured 71% marks thrgh RTI in Dec 2012. All the successful candidate in written test have been promoted. An explanation was called on 13/12/2010 for charges that business outside the scope of employment. chargesheet was issued on 22/12/2011. Please guide whether the promotion given to me or not.

Promotion is given after vigilance clear, which mean no disciplinary case should be pending against the employee at the time of promotion. If charge sheet has been served, you would be entitled to get promotion, if due on merit and permissible under rules, after you are honourably acquitted of the charge, i.e., without award of any penalty. On award of penalty your promotion case, if so due, can be considered only after expiry of the period of penalty.

As far as promotion is concened the gravity of charges is not relevant. You are not getting promotin during pendancy of chargehseet.

If you are exhonerated then you can get the same retrospectively.
