Divorce with mutual conscent

(Querist) 17 February 2013 This query is : Resolved 
Me & my wife are looking to settle 498, DV cases and also filing divorce. Legal procedure to grant divorce takes at least six months. settlement amount has been finalised.

My query is, can my spouse can surprise by saying no at second hearing after six months.

In that case, what options I can have?

Your wife can definitely say as anticipated so it shall be better to take a third person in between who shall make the payment of settled amount only after making second statement.

You are advised to execute MOU between you and your wife pay the half of the agreed settlement amount. The remaining half at the time of hearing.For mutual divorce both should file petition U/s 13/B of HMA.

Do not make whole payment before the divorce is finally granted.
If wife refuses to come on final hearing, you could nothing.
