Defamation!

(Querist) 28 April 2012 This query is : Resolved 
In a mala fide police report submitted before the court of law related with a criminal investigation by the police they have written that “The original informant has lost his mental balance”.

Is it sufficient ground to prosecute the police for defamation?

Police/Investigating agency can not be prosecuted for defamation if it is done in course of its official business though you can apply for expunging that remark.

No you cannot prosecute police dept, because it is done while discharging their official duty.

As sch defamation cases are useless. What damage u can claim?? how many persons knew remarks of police? who informed them?? certainly not police.

No sense thinking defamation.
