About photographs

(Querist) 15 January 2012 This query is : Resolved 
That in the case u/o 39 R 2A CPC the applicant filed some Photographs on Record to show the breach. Now the case is fixed for my cross examination ( I am for Non-Applicant)
My query is :-
1) How the Photographs can be exhibited, provide case laws and provisions if any

2) If I asked the question on photographs in Cross examination then the court can exhibited those photograps automatically. ?

3) If the photographs not exhibited and I did not asked any question on it what will be effect of that in Judgement ?

4) Guide me more on photographs ?

1. This is Misc Case where then petitioner has to go through the same procedures as prescribed for trial of a suit.
They exhibit of photos are available if it is not disputed. If disputed then it has to be authenticated by an expert.

2. If you dispute its authenticity then it would not be exhibited.
3. Then it would be exhibited and later you can not challenge its authenticity.

Ask only general questions about the photograph but do not refer or show them to the opposite party,otherwise on referring the photographs,they will be exhibited;.The photographs can be exhibited only on production of negatives and examination of photographer.So wait till the applicant calls the photographer and produces negatives.
