How to eliminate brother's objection?

Querist : Anonymous (Querist) 02 January 2012 This query is : Resolved
Hello All
As I asked earlier my mother had self acquired property(1955) and she expired on 2005, I am ealder son of her my occupation is only agriculture with consent of my mother property i earned 10 acre of land (1969-1980) registered on my name. now i sold out some pice of land to my doughter... My Brother(younger son of her) filed the objection for this sale..
by stating this is joint family property..
what is the next action i have to take?

as per information of this forum its not a joint family property!

if it was your mother self acquired property and she gifted 10 acres to you and the said property is in your name then your brother cannot object to sale of property .

If the property is registered in your name then your brother would be in good trouble to establish his right.
Your better sell the property and enjoy the profit.

As you earned property and duly got it registered in your own name may be during the life time of your mother hence the purchased agricultural land belongs exclusively to you and not to the joint Hindu family. Your brother has got no right, title or interest to challenge your sale in favour of your daughter.

Rightly advised by Mr. Rajkumar Makkad.

I recall this query.he can not stop mutation objecting it to be joint hindu property as all is in your name.He would need to file a suit for declaration in civil court, and god wish ,you shall succeed.
