Husband not accepting infant baby

Querist : Anonymous (Querist) 21 December 2011 This query is : Resolved
ritu gets married to deepak thru shaadi.com. ritu is frm kolkata and deepak from mumbai. After marriage she stays with her parents-in-law, unmarried sister-in-law and deepak's unmarried aunty. she soon finds tht the family is cheap. deepak never took any interest in ritu and was always dominated by his father so much so tht he even used to ask his father before even getting physically intimate with ritu. Deepak's family's main intention was for ritu to bring dowry (so tht they can marry deepak's sister) and give birth to a son and divorce deepak so tht deepak can re-marry. Ritu's mother-in-law sent her to her parent's home whn she was 3months pregnant in the name of tradition that a girl's 1st child is delivered at her parents's place. since then no one kept contact with ritu. deepak however used to call ritu but only to fight over trivial issues and torture her mentally affecting her health. following this torture, ritu and her family stopped talking to deepak. deepak too, despite knowing about ritu's expected date of delivery, never enquired about his baby and after waiting for a few months, whn ritu's father called deepak, he started blaming ritu's father for not informing him. ritu's father tried explaining deepak tht he was busy with ritu at hospital, the baby, his own office, gathering all the money expenses etc. however deepak didnt understand and refused to accpet ritu or the baby back. he didnt show any interest in the baby and neither is intersted in even seeing him. kindly tell about all the kind of sections/charges ritu and her family can press against deepak and family? is there any section that ritu's father can charge against deepak? i thank all the responsers in advance plsss help..

it is indeed sad that your husband is refusing to accept his own child his own flesha nd blood . you can make application under section 12 of Dv act against your husband . you cna seek maintenace , right to stay in shared household , compensation from your husband .the application can be made in kolkata before magistarte

There are plenty of sections ritu could bring against her in laws but is this a solution?
If she does anything like that she should forget reconciliation for good.
If yes then she file cases both under PWDV Act and under section 498A. 406 IPC etc.

Claiming maintenance is also another additional option.

In the given facts. ritu cam demand maintenance for herself and her baby as well as DV case and 498 IPC case.

At Mr Burman: u r rite in saying that ritu wud lose her chance for reconcillation in case she files any case against her husband and in-laws. keeping her infant son in mind she has tried for reconcillation thru an NGO.however her husband didnt reciprocate to them too and instead put a lot of false blames on her. apart from going legal, do u suggest any other possible way to teach ritu's husband a lesson and force him to acknowledge his responsibilities towards her and son?
