Sir,
i require the information related to service book records of retired Government Official and the process of appointment of the said government official and certified documents related to the appointment of the said retired Government official who is at present a pension holder. The record relates back to year 1967-68 and took voluntary retirement in the year 1988. Can I get the service record books and papers related to appointment of the said retired official from the parent office of the person under RTI Act, 2005? Whether these records can be asked by any person who is not blood related to the person or whether the records can be asked by blood related persons only of the retired official then on what grounds can these records be taken from the parent office?

If the subject person asking about his service details mean, there is no bar under right to information act. But if any third person try to ask the information mean that can't provide under rti act.

The details of service particulars i.e pay,date of recruitment etc., can be supplied under RTI since they are declared as public documents.But, regarding issue of copy ofservice book, the department could refuse pointing out 'invasion of the privacy of the individual' under section 8(1)(j)of the Act.

Since the retirement related to 23 years back (1988) and if the retired Government official has already died, the service book would have been destroyed after certain years of preservation after he would have died.

Copy of service book record, as a whole, can be asked for by the employee himself, but not even by his blood relation what to say of a third person.

However, under RTI a few of general particulars, as Mr, Isaac Gabriel has mentioned, can be asked for any person.

Process of appointment does not have any relation with the service book of any individual official. It is a part of administrative process, which is common to all employees and cannot even be available with the custodian of the service book.

Service books can be seen only by the concerned persons, not by a third party. He alone can apply through RTI.
