Sir,

My wife had filled a dva on my family members. She had also asked for an interim maintenance. As she insert my sister and my sister's husband in this. My sister's husband is not willing to come to court, he says that if I want to come to court then after that you stay in your mother's home itself. Is there any possibility for avoiding him? In the DVA main she said that we are threatening her to give divorce to me. But I had filled a RCR for reunion, on that time she says she is not interested for that.

1. Is there any particular reason for that?

You can not challenge the inclusion of any of your relatives at this stage.

The PO gives only the exparte order.
When the complaint would reach the court, your brother in law liek other respondents can enter his appearance through vakalthnama only, no need for personal appearance.

The PO is also sending summons. based on the enquiry the PO will send DIR to the Magistrate. Based on the DIR the magistrate will pass orders and may order summons to the parties.

If your wife is changing her statement then it is in your interest. Obtain certified copy of her statement if recorded and produce it before the court wherein her subsequent matter and falsify her and raise doubts about her credibility.

The behaviour of your brother in law is not understandable. What your sister can do when your wife has impleaded him. He should be convinced properly.
