Seller token money refund

my mother is the owner of apartment, which she intended to sell. She has taken the token money from a buyer about a month back. She however, would not like to sell the property cause she intended to give it to her grand kids. she is willing to refund the token money with current market interest. She accepted the token money a month or two back. But the buyer now wants the apartment and threatening legal action. what can she do.

was token taken in cash or cheque? has your mother given any thing in writing . ?

yes,if the token money was taken in cash and nothing was given in writing,legally nothing can be done.

If she executed agreement then buyer could go to the civil court.
