(Querist) 18 August 2011 This query is : Resolved
what was the difference between petition and suit
Jainodin shaikh (Expert) 18 August 2011
1] in a suit the plaintiff claims some rights & in a petition the petitioner requests some remedy!
2]Suit is always civil in nature but petition can be either civil or criminal.
3}'Judgment' is the final conclussionb of every suit & 'order' is the final conclussion of a petition.

i agree with Expert : Jainodin shaikh .
The 'suit' is a term limited to the jurisdiction of civil court vested under section 9 of C.P.C. to establish and enforce a civil right through a pleading called plaint.A SUIT CAN EITHER BE DECREED OR DISMISSED WITH REFERENCE TO RELIEFS SOUGHT FOR BY IT.

On the other hand a PETITION is a bit more comprehensive term which may be a CIVIL or CRIMINAL and usually lie due to SPECIAL LEGISLATION CONFERRING SPECIAL ORIGINAL JURISDICTIONS ON ANY AUTHORITY SUCH AS SUPREME COURT/HIGH COURTS/TRIBUNALS etc. whose judgments are enforceable as orders /directives and perogatives.
