easementory rights are not governrd by documents. it makes no difference if it is mentioned in some document or not. it is a factual right and a document is one of the modes to prove our right . you can lead oral evidence.

I agree with Mr. J.K. Agarwal. Easement is defined as a liberty or privilege or advantage which a man may have in the property of another. They do not depned on the contracts or agreements.Thus the owner of a building can ask his neighbour not to construct anything in his preoperty so as to prevent natural light and air to his building.
