I have constructed a Plastic shed on
metal structure of my open
terrace which was regularised by Kolkata Municipal Corporation under Section 400(1)of
KMC act 1980 after full compliance of KMC requirements Like structural reports,payment of penalty/retention charges of KMC etc.
Subsequently, a flat owner above my flat had
challenged the said construction and order of KMC and filed a writ in Calcutta High Court for demolishing the said constructed structure.
My question is that can Calcutta High court will take Regularisation order of KMC for granted and reject the writ or not

court will consider the order of regularisation and pass reasoned order after hearing arguments .
