Dear Seniors,
I am party in persn for my divorce duit, field against my wife.
Can an amicus curiae petition be filed for my divorce suit, to avoid of missing of dates and to get updates from the court.
Would it be of any more help to me.
My next hearing is after a fortnight.
Can i file this now, is it a right time to do so.
Advices please.

No, amicus curie is appointed in cases of great public interest or which involves some intricate points of law. Your case is not fit for that.

In any case, Amicus Curie means friend of the court and Amicus Curie is appointed only by a Court for its assistance and not for the assistance of any litigant. Having filed a case in a court of law, it is for you to make arrangements to know the dates and proceedings. If you had engaged a lawyer, he/she will be taking care of such things. From the way you have indicated the facts in your post, it appears that you have not engaged any lawyer.

if you want to appoint the animus curie then you have to move the application to the court that you fulfill the criteria that you cannot engage a lawyer and then the court shall send the Legal Aid committee for the lawyer and from there you can get the lawyer. if you engaged a lawyer then the court may dismiss your application.

Amicus curie can not be appointed at the request of the litigant. If he want the legal assistance, he can approach the free legal aid center.
