donated land

I have donated a plot of 15 marlas in1999.the transfer deed was executed on name of charitable trust and vocational center.nothing was constructed on the plot by the said trust, now the trust has exchanged the plot with another plot by registered transfer deed. iwant to know that donated land can be transfered or exchanged,without the consent of donor? whether donor has some right over donated property?

Dear Aman:

The moment the donee accepts the donation the donation is complete legally. How did you donate it, was it thru a gift deed. its not possible to decipher the true meaning of transfer deed?what is the deed and did you specify the purpose of the donation specifically in the deed. The outcome of your reply will decide the case.

Dear Aman
Once you have donated the plot and the same was duly registered then in that case the right of Donor ceases but if the plot has been exchanged against the interest of Trust to which you donated then legal action can be taken against the Trust or guilty party. Moreover lots depend on the deed vide which above plot was donated.

all is depends on the terms and condition of the transfer deed and if the said deed was not registered. The true owner is still you.If the deed is registered one and the donation was completed.In this case donee and donor is bound by the terms and condition mention in the transfer deed.

whenever you have donate that plot and was to be duly registered, then in that case the right of Donor will be ceased.

if the plot has been exchanged, against the bonafide interest of Trust, to which you donated thereunder the legal action can be initiated and instituted, against the Trust or guilty party.

Moreover terms and conditions depend on the deed vide which above plot was donated.
