Divorce case

Querist : Anonymous (Querist) 27 April 2022 This query is : Resolved
Respected Experts,
I don't want to state the facts here just want to know -
1. is Registered Deed of Divorce valid?
2. is the mutual consent agreement for settlement and divorce valid?

Please do answer and sorry I can't post the facts here.
Quick Summary
This discussion addresses the validity of a registered deed of divorce and mutual consent agreements in the context of divorce proceedings. Experts generally agree that while these documents can serve as evidence of settlement, a decree of divorce from a competent court is ultimately required for legal finalisation. Mutual consent agreements are considered valid if they are settled without coercion and with valid consideration, and can be used when filing for a mutual divorce petition.

In my view, No. Both the two are only for evidence purposes but not otherwise.

You can file mutual divorce petition referring the settlement deed agreement. Both the deed are valid if the dispute has been settled under valid consideration and without coercion. It is our normal practice to make settlement deed between the parties and thereafter referring to that file mutual divorce petition. But I cannot comment on registered divorce deed! What is this?

No,
Both of you will have to obtain a decree of divorce from competent court.
