My wife filed false 498 and dv against me I got acquittal in 498 we are not living together from last 2 years, now I want divorce, she is refusing to give divorce now she is saying I want to stay with my husband. If I refused to take here back will I have to pay money what ever she demands and also I will have to give marriage expenses to here.

If your wife is unemployed you are liable for payment of maintenance.

You may have to pay maintenance to her on divorce.

Living with her may again invite cases against you.

Settle the amount of alimony (which is her right) out of court and move for mutual consent divorce, if possible. Otherwise, file a petition for a decree of divorce and contest, however, you will have to pay life-time alimony for your wife, as decided mutually or by the Court.
