Discharge petition

dear sir
i am a accused in a 420 ipc case in bangalore magistrate court.
i have filed a discharge petition in the month of may 16 2013. but the judge is not giving time for agrument and just giving three month date. so can i file a petition in the high court of karnataka to hear my discharge petition with a time limit in the lower court or a liberty please tell me know under which petition i can file and even public prosecutor as filed objection for the discharge. and chargesheet is filled on july 2012.
any chance to fill 482 petition
