Custody of grandparents

In what grounds do grandparents get custody of child? Both parents are alive but divorced and father doesnot care towards the child.so how are court procedures and what law would be applicable? Please Help

Welfare and interest of minor is paramount consideration, however, grandparents have least chances in comparison to either of the parent.
Read the provisions of Guardians and Wards Act section 12 & 25, however, you have no alternative but to seek the services of legal professional/ expert.

Since they are divorced, to whom the custody handed over by the court? If it is awarded to father, the grand parents should be in a position to prove that interest of the children is not protected by such award.

if father is not interested in child custody then mother should be granted custody of child . chances of grandparents are bleak

but can the grandparents be appointed as guardians? n how can they prove that father is not taking proper care?

Engage a local lawyer for appointment of a guardian which will be decided by the Court on filing of petition on its merit and evidence.

Father is the natural guardian and after him mother will be the natural guardian. Only in the absence of both the parents, the grandparents can apply for guardianship of the child,consult you lawyer and prcoeed as per his opinion.
