Cross examination

(Querist) 22 December 2017 This query is : Open 
Suit for partition pending in court and at the stage of plaintiff evidence for cross as in previous date plaintiff was crossed partly. Now the plaintiff have to move urgently else where and cannot attend the case for remaining cross on next date. Please suggest solution if someone else can attend on plaintiff behalf.

Cross of plaintiff is not complete and only he has to appear for cross and no one else on his behalf can do this.
Another date for the remaining cross examination of plaintiff can be taken on next date by his counsel.

Plaintiff if avoid attending court case in spite of repeated adjournments, his suit can be dismissed by the court.

Glaring dilatory/delaying tactics may be visible to Presiding Officer.
Presumption that case that is set up is not correct, may arise.
It may be felt that cross cannot be avoided.
Depending upon Presiding Officer opportunity may be given and/or may award costs, closure …
The option of reopen by appeal may be possible.

The counsels on both sides would know what is to be done!
