Conusmer forum or any other?

Querist : Anonymous (Querist) 23 January 2012 This query is : Resolved
electricity equipment in every street reaching electricity in home
Facts: some boys playing around this equipment and died because of blasts in equipment
whether compensation for this accident
file to counsumer forum or not??
any citation supported to this case??
Thank you
Deepak Nair (Expert) 23 January 2012
IF it is proved that the blast had occurred due to the substandard quality of the said equipment, then you can move to consumer forum.
You can initiate consumer complaint only if there is any deficiency in service or unfair trade practice on part of the manufacturer of the said equipment.
If the reason for the blast is not because of the fault of that equipment or that equipment is out or its warranty period, then you cannot initiate a consumer complaint against the manufacturer.

Consumer Forum has no jurisdiction to try and decide such type of matters. The case can be only filed under the provisions of The Fatal Accident Act 1855 against State Electricity Board and Municipal corporation to recover damages.
Advocate. Arunagiri (Expert) 23 January 2012
It is a accident, not a consumer case.

Go for writ seeking compensation from the Govt.
