ONE OF MY CLIENT WON THE BID OF HOUSE FROM STATE BANK OF BIKANER , AMRITSAR. At the time of taking delivery of the house , It was found that the house was pledged with two Banks . One with original Deed at S.B.J and other one with fake deed with B.O.B. My client want to file case with consumer court after filing complaint with Branch Manager and General Manager. In bid , It was specifically mentioned as to free of encumberance. Please clarify as to whether client is entitled to file case with consumer court and also provide rules and regulation of consumer court. if possible.

Since some complicated questions on title of property is involved here I do not think the case is maintainable before the consumer forum.

why should your client initiate a case?
your client got the bid from SBJ,who has the original deed with them.How could SBJ aware of any fake manipulation?
Let BOB go for the case and prove the right in the property.
