iF DELAY WAS BEYOND THE CONTROL OF THE APPLICANT THEN IT MAY BE CONDONED BASED ON THE SPECIFIC FACTS OF THE CASE AND RELATIONSHIP OF THE GROUND OF CONDONATION WITH THE DELAY.

It cannot be generalized. But the courts condone the delay after taking into consideration, the circumstances and the facts produced by the parties concerned. Further the reasons depend on each and every specific case and the position of the parties aligned against each other.

The SC has even said the delay is not vested interest of the party so even if he / she is not able to explain delay the procedures and law should be inter preted to impart justice and not denial of justice.

The Apex court has made a distintion with respect to the condonation of delay sought by the parties
1. for individual the law of limitation runs when the things comes to his knowledge and there is no red trapisum menaning there by he is the suo moto decision maker of the remedy to be availed.
2. for government departmnets the decision is to be taken by hearchy of the officers and due the red trapisum {afsershai} the decision is delayed and no one compelled the other officer to dispose of the opinion file with in a day or two. so some delay is caused there fore the apex court has dealt with the same leniently and the delay is condoned with the explnation which is averred in the application for condonationof delay, which is not in the supra mentioned available easily.
