Querist : Anonymous (Querist) 27 September 2019 This query is : Resolved
60+years old lady is staying in Mumbai BMC bldg. This bldg will be soon undergoing for redevelopment. Society of the bldg is formed. Room is in lady name. Can her brother in law become associate member of CHSociety? Does he become joined owner of room after redevelopment?
Kishor Mehta (Expert) 27 September 2019
He can become an associate member, however he cannot become a joint owner unless necessary legal documents are stamped and executed.

Thanks for the reply. What are the legal docs in case of room which is with BMC n soon it will be redeveloping??

Dear Anonymous,
Associate member has no rights and he cannot became the joint owner of property. To became joint owner one has to sold or release the part of flat in his name.

What is your concern or locus standi with the building and/or title of the property vis-a-vis transfer in the name of brother-in-law during or after life time of the owner aged lady?
It is a vague and confusing statement posted by an Anonymous person.
It would be better to consult a local prudent lawyer for appreciation of facts/documents, guidance and proceeding if there is some truth in the story.
