Cheating

(Querist) 19 May 2015 This query is : Resolved
I sold my friends property by using his POA 14 years ago with his verbal advise..I gave full value to him without poof.the buyer enjoying possession of land until now by paying land tax in his name
Unfortunately now my friend has some dispute with me on financial matter.he telling the POA was wrongly made.so he will give petition upon me on the basis of wrong POA.
Actually he executed this POA from abroad.I didn't make any change in it.I just presented it in front of registrar officer and he allowed registration 14 year ago.

If now my friend make cheating case upon me,
How can I prove my side?what will happen to sale deed which registered 14 years back?
Can I get copy of POA which attested in 1996 from Saudi Indian embassy?if the changes happened by him,how can I take responsibility?
Will buyer take legal action upon me?

please consult local lawyer with the papers as the matter is subjective.

If your friend prefer to proceed against you, consult a local lawyer and show him all the documents.

Your query is academic one. Even if you really have narrated the correct story, the query is premature when your friend has not filed any case against you.

Ask your question only with reference to the problem, if any, as and when you actually are made to face. Till then don't take any tension.

You have no role in preparing the POA as it eminated from abroad by your friend. You have only acted upon it belieiving it as genuine. If there is no fowl play, it is not because of you. What is the stand your friend? Does he say POA is fraud? Does he say you have not paid the consideration? What are the terms of POA? When he is in abroad, how you have paid him the sale consideration? Since the POA is locally submitted to the concerned Sub-Registrar and duly registered, unless you have known fraud, you will not be in a trouble as per the contents posted in the query. Anyway wait and see.

Was the sale deed registered and if so, had you executed the same in your capacity as PoA? If so, there is nothing for you to worry.
T. Kalaiselvan, Advocate (Expert) 21 May 2015
The POA was registered. The sale deed based on the POA too was registered. Therefore all the actions that have been done on the basis of POA is deemed to have been done on the instructions of the principal in good faith and the matter is as old as 14 years ow. Hence, wait for the developments from your friend's side and take necessary precautions or action once he has initiated the proposed legal action against you.
