sir,
after a long gap i am back again with a doubt. As per your instruction i filed a suit in the court regarding the change of name and date in birth certificate of my husband but unfortunately the court has rejected my case it seems as I am not the one to move the court . My husband who is in Latin America is supposed to put up the file in person it seems. so my advocate has withdrawn my case from the court. My husband will be back only on May .what should i do.
please help me on this

For change of name,Gazatte notification will suffice.For change of date of birth alone you need ti file at court.

Discuss with your lawyer whether case can be filed through Power of attorney.

power of attorney needed in my view for filing for court sanction for change of date of birth,as said by experts above.
change of name approval can be given by executive magistrate (on submitting notarized affidavit,). approach with your advocate, help.
i feel gazette notification is for govt. servants only.

The POA has to be executed by your husband from Latin America only to conduct a case here in India on his behalf. Change of name can be done through a publication in local newspaper and if required through a gazette publication too. But change of date of birth can be done only through court, for which you may have wait until he returns to India.
