Respected all experts,

DV case

In the matter amount to pay in interim maintenance are present, we are not in a situation to pay but we have evidences that family of wife having money of husband

1-can we produce these evidences in the same court to adjust the amount what husband has to take from family of wife with with the interim maintenance arrears------ or we have to file separate suit for that ?

There is no wrong to try it by filing an application before the court.

The husband has no option but to pay the interim maintenance untill the same is set aside by the higher court.

The fact mentioned by you is not sufficient to avoid maintenance.

if the interim maintenance has been decided and the same has not been stayed by a higher court, you would need to pay maintenance otherwise face execution.

The trick is to run the case faster and decide permanent maintenance, which can be denied on many factors.
