Case

I have filed one case for recovery suit in civil court and one case I have filed before the Labour Court for reinstatement against the employer. My query is that is there any citations where I can prove that bother cases are different from each other.

Thanks. Sir, anyhow can you please clarify that case filed in civil suit for recovery and for reinstatement case filed in Labour court is appropriate as per law. Please advice.

Case can not be filed in two courts for same cause of action.

Without referring your full case file no advice can be given in your case.

As I fall under category of workman hence I have filed case in Labour court for reinstatement of my services with back-wages. In civil court I have filed case of civil suit for recovery of damages charges on account of mental harassment, agony and violation of employment rules. Presently my both cases are under trial but my inquiry is that could it clash at some stage although the nature of case is different from each other but grounds are same.

I have filed both cases through Advocate. One advocate handling my case for recovery and another advocate handling my case for reinstatement before Labour Court. They have replied that since both cases are related to each other but relief sought is different to each other hence it is right as per law. My general enquiry was just a faith upon the LIC advocates for out of any grudge help clients like me. Thanks

You want an opinion from this forum without facts of the case. You do not want to trust your two lawyers who have seen all papers.
