This query is : Resolved
I am a member of a Co-operative Housing society. The building has three wings A, B , C. registered as one co-operative housing society under Maharashtra co-operative society Act. Since its registration i.e.1990,it is one society managing the affairs of the society.
Recently the members of the different wings want to separate and have three soceities in place of one.
Is this division possible under the Maharashtra Co-op. Society Act 1961? Please advise;

Anand ji! You can do this subject to passing of a specific resolution of current society. There is no legal hurdle to do so.

There are legal obligations to be complied with by a housing society such as anuual return, audited accounts, membership records.There is a Registrar Co-operative Socieites where in society is registered as one entity. How one society having one registration number with the registrar can be bifurcated into three societies? Beside there are some common utilities in the society such as water and severage system, electricity supplies and street lighting. How this responsibility can be pieced in to three?
