Can police io enquire complainant beyond his jurisdiction

Respected sir I complaint against a person in his police station jurisdiction which is 70km distance. IO sent me summon for enquiry. That person has already four FIR (25 secs.) in the same PS. Moreover I m byepass surgery patient. I don't want to go there for enquiry for security n health reason. Can police come to my place or any other nearest police station to conduct enquiry? Is law permits?

Complainant can complaint to the limits of police station.It is fir the io to investigate no matter where the accused.

If you can go to lodge FIR 70 km away from your home then why you can't
go for police enquiry.there?

Hello,

Police will not come to your place for inquiry. But you have to go to the police station for recording a statement. You can complain to the police about apprehension or any threats.

No police officer has normally any authority to investigate into an offence in which no part of the offence occurred within the jurisdiction of the police station. The jurisdiction of the police is determined based on the jurisdiction of the Magistrate who has the power to try that particular offence.

However, there is an emerging concept of registering Zero FIR in cases like rape sexual assault etc based on the advisory of the union government. In such cases the police have power to conduct some appropriate investigation and to send the report of findings along with the Zero FIR to the police of original jurisdiction.

Zero FIR has come to existence not based on any law amendment but based on some case laws that relied on the 2013 J S Verma Committee report regarding Delhi gang rape which suggested it.

You can write to police regarding your illness. Police may give some other date.
