Buying agricultural land

I want to buy agricultural land in Maharashtra, but i am not a farmer or our ancestors were not farmer.

Means we are not "khatedaar"

Then how to buy ?

It simply means that a non-agriculturist cannot buy an agricultural land.

Thanx sir for prompt reply.....

But there should be some way... one of my relative informed me that we need to get 7/12 certificate.....but he or me dont know how to get it.....is this possible by this way...if so approx how much cost is involved..

somebody else informed that we can convert it to non-agricultural land and then buy it....is this procedure easy and economically feasible ?

also at below link i found 1 soultion povided my MR.MURALI but dont know thats right or not ?

Dear Mr. Ramesh,

Legally you cannot buy. Regarding illegal means I do not know.

As far as the solution given by Mr. Murali at http://farmnest.com/forum/farming-news-articles-policy/minimum-area-land-to-buy-for-farmer-status/

I can only say that it is a vicious circle. Mr. Murali has conveniently omitted to mention how a non-agriculturist can buy an agricultural land. I do not buy that solution.

7/12 extract to which you have designated as a certificate is a record of owners of the agricultural land mentioned therein. If you cannot purchase agricultural land in Maharashtra because you are not farmer so no question arises to get inserted your or your friend's name therein.

Murali can be got contacted by you, if he is ready to help you over and above of legal provisions.

As it seems there are no legal ways, i think i will look for non-agircultural land....

Sec.43 of the Bombay Tenancy and Agricultural Lands Act provides for resitriction of sale or purchase of agricultural land in the state of Maharashtra and Sec.63 provides that the transfer of agricultural land is barred:-
No sale, gifts, exchange or lease of any land shall be valid in favour of person who is not an agriculturist. However collector may grant permission for transfer under the below mentioned conditions:
a)
Such a person bona fide requires the land for a non agricultural purposes; or
b)
The land is required for the benefit of an industrial or commercial undertaking or an educational or charitable institution; or
c)
Such land being mortgaged, mortgage has obtained from collector a certificate that he intends to take the profession of an agriculturist and agrees to cultivate the land personally; or
d)
The land is required by co-op society; or
e)
The land is required for cultivating it by a personally by a person, who, not being an agriculturist, intends to take to the profession of agriculture and to whom collector has given certificate that such person is intend to take to the profession of agriculture and is capable of cultivating land personally; or
f)
Such land is being sold in execution of decree of a civil court, or recovering arrear of land revenue.

Here, Sec.63(e) provides a good chance for you to purchase the agricultural land in Maharashtra.

I would luggest to consult a local lawyer for the same.

If you are not an agriculturist then you will have to take the permission from the Ass., Commissioner to purchase an agrl., land.

Dear Mr. Barman,
I have not answered "Anonymous" queries. My resolve stands.
You will notice that I have answered the query by addressing the querist as "Dear Mr. Ramesh". This was possible because the LCI site was revealing the name of the querist even though posted as "Anonymous".
Today I find that facility has once again been removed by the LCI.
