Pending maintenance dues from a non co-operating flat owner

Dear Experts,
Need a guidance on the below:
We are an apartment association registered with Registrar of Society, Karnataka.

There are in total 35 flats in the apartment. One of the flat owners is very rude and they have moved in to the flat without obtaining an NOC from the association though they knew that the previous owner had some pending maintenance dues. The notice in this effect was prominently displayed on the entrance to the lift and passage. Also they have chosen not to become members and membership fee is still not paid. They forcefully park their vehicle in the parking area eligible for their flat, though the parking space is not yet allotted to them by the association for non- submission of NOC before moving in to the flat.

They are very irregular in payment of monthly maintenance dues, as well as other payments towards society developmental charges. The maintenance is due for more than 18 months. They do not stay in the apartment and they don’t visit also, as the flat is not occupied. The association has been following up for the dues since long time without a luck. Very recently, when they visited the flat for renting it out, association approached them to discuss about the pending dues. However, they argued and said they are not going to pay anything as the flat was not occupied. We referred them to the relevant clause of the association bye laws which talks about amount as decided by the association . Suddenly they became violent and came attacking one of the association members. Considering the verbal abuse (foul language) & loud threatening words and basis the CCTV footage we filed an NCR with the local police station. Though outside of the police station, they agreed to clear the dues but there is no action from their side yet.

Hence the association has decided to proceed legally to collect the dues with interest, as per bye laws. In this reference, we approached a legal help but his advise has raised further questions. He says, even though we are registered with Registrar of Society, we can’t proceed for collection of pending dues, unless the association is registered with some specific authority (just like municipal authorities).

- Is there any such law which stops the apartment association from collecting the genuine outstanding just for not registering with a specific authority?
- What is the legal remedy for recovery of outstanding dues from apartments owners and under what section laws?
- What is the procedure for initiating an action?
Any valued opinion and guidance from the experts
We would request opinion vis-à-vis laws in the state of Karnataka if any.

Drafting sale deed.

I am proposing the sell my property, for the agreed price with the buyer.
while drafting the agreement, the Buyer, insisting to caption the word as
"In the name of God, and the Holy scriptures in the Hindu religion" agreed to enter into this agreement on ______this day ________-(month)__________(year).....

is it okay to write this on the legal document, and whether it is valid to write these captions, I have not so far find this any the sample or format agreement copy like this.

only because of this the discussions were on .. and on...

Experts, please, advise and guide, on the legal implications if any on this.( I have no issue to write these captions, as I am also Hindu, but do not know whether legally, valid or not)

Interse-seniority of main list and wait list candidates

what will be the seniority of main list candidates and reserve list candidates. when, any candidate (OBC) join the post in 2017 and a reserve list candidate (UR) join the post in 2018. where reserve list candidate has secured high marks than the main list candidate.

Obc certificate name mistake

Respected Sir/Madam,

My name is Pazhanimurugan A

I have obtained my OBC certificate through TNeGA which valid till 31.03.2022

Which mentioned as Pazhani Murugan son of Appathurai mistakenly because of my old Aadhaar proof. I have recently updated aadhaar correctly as Pazhanimurugan A and M Appadurai as per my 10th & 12th and Graduate certificate.

I want to correct my name and father name in this certificate which would necessary for my upsc examination. so please tell me in what way I would able to change it.

I have explained to my taluk office regarding issues but they said we cannot change in online verified certificate, you have to wait until the certificate date is expired.

So please suggest me possible way to resolve this issue .

Committee election process for a co-op society

Our secretary has been avoiding elections since last more than 5 to 6 years saying the registrar has been intimated but they are not coming for the election. He has shown us a circular that shows that during these corona times the elections cannot be held until 31st august 2021 and has shown us some news clipping.
We are a very small society of 40 flats and have not conducted any election/selection since last at least 10 years.
I would like to know if there indeed is any circular that says we cannot hold elections before of corona. Can the elections be conducted online?
Does a small society like ours need to have the registrar's presence to conduct elections? if yes, does the government have a specific timelines within which the registrar will give appointment for the being present in the election? We are being constantly told by the secretary what we tried for elections called the registrar but for years they did not give us appointment and when followed up they asked for 50,000/- to come and do an election.
We are a society of just 40 flats and elections have not taken place since last 10-12 years and most of the committee members had vacated the chair and only the secretary is running the society along without any other committee members concent.

What is the meaning and long form of NOB or TOB?
