Hello Respected Members,
My bhabhi put 498A and DV case on my elder brother and parents.
After 2 year the police has finally filled chargesheet. In CS reagaring my parents they said they are supporting my brother and asking aditional dowry.
We would like remove our parents name from CS , is it right to appeal in Hihg court or we should fight case on merit in Lower court only.

Owner applied for eviction suit based on his requirement which is defended by Tenant. Now owner has produced documents to show Tenant has other commercial place of business also. Will the owner benefit in any way by arguing Tenant multiple branches

I own a house in nallasopara west... and I want this house in my Dad's name now..however jus bought the home and don't have money to do the registration again and heard that daughter cant directly transfer the house it has to be a proper registration... also heard abt making a gift deed.. can you tell me how much it would cost and if there is any other way of dealing with this

I had availed a personal loan of 45000/- from Bajaj Finance about a year ago. Due to the situation I could not pay the EMIs for more than a few months. I was harassed a lot. Bajaj Fin even made fake lawyers and police officers call me on phone and threaten me. Finally I agreed to settle the amount.
The agents had collected a blank cheque from me during the time of processing the loan. Now shockingly Bajaj Fin has filled the cheque recently with an amount of 49000 and have got it bounced and filed a case against me.
The complainant claims that I issued a cheque as a fraud and moreover I live in Jamshedpur, Jharkhand but the case has been filed in Calcutta, West Bengal.
It is a mental harassment and even physical as I will have to go to calcutta. What can I do to get rid of this trouble of the case and how can I get the complainant punished for the fraud?

Dear sir,
After lapse of 4 years A obtained a birth certificate for his son from gramapanchayth president in Bangalore district Karnataka and admitted his son in a private school now he is 7th standard . Later A and his wife expired recently.. After verification it is learnt that A has bought this boy from a village without adoption or guardianship what is the legal santity

A Hindu marriage petition u/s. 13(1)(ia) has presented in family court through power of attorney holder of petitioner wife (lives in foreign country). Respondent (husband) believes that the petitioner must appear in family court during proceedings of mediation/conciliation, evidences and cross examination and family court does not entertain power of attorney in matrimonial cases and it is very possible that family court would reject the petition on this legal position. Now, Respondent husband has to file reply/written petition in family court. Husband does not want to appoint lawyer.
Que 1: Can Respondent husband alone (without appointing lawyer) oppose the appearance of power of attorney holder of petitioner by presenting simple application in the family court mentioning that the petitioner must be present in person in family court under section 9 of the family courts act? OR Is it advisable to appoint lawyer in this case?

I am working with a PSU Bank . I had been married on 08 Dec 2010 with Priyanka Sharma D/o Harendra Kumar Sharma. Ever since I got married my wife & father in Law always pressurized me to be away of my parents & Family. My father in Law always insists me to get myself transferred to the place where he is residing (Jharkhand)
He says I have some political connections If You write an application for the same I will try to get you posted at the place where he is staying.
Currently I am posted at Sundernagar (Himachal Pradesh). Previously I was posted at Ludhiana (Punjab) where my father in Law created nexus with some Local peoples who had a political background. many time he came from Jharkhand with some Local peoples who were belonging to Akali Dal Political Party and started threatening me that If you do not go according to her you will have to face severe consequences. With their support many times I had been called at police station and alligated me for domestic violence and misbehavior which was out of truth. He threatened my parents as well that If they go to stay with me then you will be responsible for everything.
On 5th January 2013 she filed a DDR at PAU Police station and went to the house of those people. I was picked up by Police They behaved very rudely with me throughout the way as Police had no sympathy with a male. That too all Police personal were already influenced by that person who had Political backup. Even at Police station they forcibly made me sign some documents which were written in Punjabi which was not familiar by me. When I asked about the contents then he replied chup chap sign kar nahi te kutt pai jugi (sign here otherwise you will be crushed). I was compelled to sign those papers which were not readable by me. Then I was taken into custody.
Then my parents arrived at Police station and even these old age innocent peoples were behaved very rudely by the munsi of that Police station. Since I was not been imprisoned so munshi said that assi tainu Jail ch nahi wad rahe es kar ke kuch sewa pani kar de.
(Since we are not jailing you therefore get me some mony.) Then he took 5000 Rs from me we were compelled to do so otherwise he was about to take me to torture room.
Then he came who was hired by my Father in Law at police station and asked me that jamanat karane ke liye wakil chahiye? I had no option other then listening to him. Then he called the same Lawyer who was hired by me. At that time I came to know that both of them were familiar to each other already.
One of the cop HC Harnek singh said to me that “ samjhauta kar ke uski baat maan le warna teri naukri chali jayegi”
Same day I was taken to Distt Court Ludhiana by Police for Bail. For taking me to court Those police hired an auto and fare was taken from me. Those Police had some tea & snacks and even for that I was charged. How ridiculous.
Then I got bail from court by an order to report back in Distt court on 17 January 2013 because till that Time If my wife withdraws the case then it is fine otherwise I could have been Jailed.
Then I came back from court along with my parents and she was still with those political peoples at their home
Later on I came to know that my Father in Law tried to defame me by writing a letter to my Banks Regional office stating that I should not be transferred to Allahabad (My home town) other wise my daughter will be tortured by my family members and forwarded the same Letter to my Head office, Vadodara & Corporate office Mumbai along with the application written by my wife to ACP Ludhiana
All the Letters signed by her were written in Punjabi which was not readable even by her.
Since it had come to know to us that she wants my parents to Leave from here & me to be as a slave. She put forward a condition to me that either I have to choose Her or my parents. Compelled with the situation I chosen her otherwise those people would have drilled me.
Considering the current situation my parents went back to Allahabad. and before that she asked me to say everyone from my family to apologies from her with non of any ones fault, compelled by the situation everyone called her and said sorry for nothing, otherwise result would have been worse to me.
Then on 17 January she declared in Distt court, Ludhiana that She had filed a DDR 107/151 in Police station PAU ,Ludhiana against her husband which happened by her due to some misunderstanding.
She also degraded me by declaring in Media for domestic violence & Dowry harassment on 6th Jan 2013 in Punjab Kesri, Ludhiana edition.
One day I asked her to go to my ancestral place to attend my cousin brother’s marriage; again she threats me that if you go then I will again make a case through those people. Then my manager talked to those political people and I could go. She said “is baar jane de rahi hu agli baar nahi jane dungi”
Since The persons who were having political background, she often used to threat me under the pretax of them and I remained as a hostage in Ludhiana and then somehow I transferred myself from Ludhiana to Himachal Pradesh. I thought Things would change here and she will realize but nothing worked, Even here she is threatening me for Dire consequences saying that my father has Links everywhere. Even here also my father can arrange manpower.
My mother is a sugar patient & currently she hardly able to adjust herself with household works. She always remains on medical advice & it is very difficult for my father alone to take care of her. She needs complete care taking but my wife is compelling me to be away of them.
My wife has another nature if I do not go according to her She threats me that if things do not go according to my will & wish then I will go outside & cry that my husband is torturing me & spoil your image in society as women’s are supported by society & Low.
Even to me she is always rude, blurting vulgar words are her common practice; always degrade my family members comparing me from others regarding money & position despite knowing the fact that my profile had already been projected to her father before marriage.
Once she called police in Ludhiana by dialing 100 no and askes them to penalize my parents in dowry and torture case during my absence in Ludhiana.
She threatened me that if they come to us then I will flee away somewhere & my father will make an FIR & to put you & your parents behind the bars. Mainer times I had stopped her from fleeing away from home by abusing my parents & family members so that she remains calm. One day I sow her paddling on roof & saying I will jump out if you do not go according to me. One day she slapped me as I was letting her know about her father’s interference.
Some times she does not eat food & medicine, Closes the door, suicide attempt. Pretending of nauseas to Blackmail me or by saying that I will go outside & cry that my husband is beating me or torturing me to catch hold to me.
Now I have filed for divorce on cruelty ground she got summon on 15 jan 2014 and on 20 jan 2014 her father came and took her along with him at hometown (jharkhand) after a month I had received an RCR letter from her, since there is no place for her in my heart I had replied for that RCR as per advocate advice. so far there is no communication between either of us and family and I have not received any summon like 498a etc. there was an appearance date on 20 march 2014 which was made by her lawyer at court. Next date is 21 july 2014.
Will I get divorce? If yes then how much time it may take?

Register marriage
Hi,
I am a hindu girl of age 25 and I wanted to marry a muslim guy of same age.As we are facing too much pressure from family and fed up of emotional black mail,we are planning to move out of India and settle down.But for register marriage we would like to know about the process.
As in India the process is like a notice will be put on both the village office of permanent address of bride and groom , we are very afraid to move forward with this .Is there any solution for carry on with a secret marriage. Atleast for an year we wanted to keep it as a secret .As I am stressed out of marriage pressure , we wanted to speed up this .
