My wife file a case domestic violence against me at another place by giving money to police....She have no proof for it...secondly i also have written proof in which Another women cell gives clear chit to me & my family.....
now my question is that...
1> It is necessary that court give her to reside in my home(house is on my father name).
2 it is necessary court give her maintenance in the form of rent.
Note : i already filed divorce case against her on the bases of physical & mental cruelty...i have proof in which i file a FIR against her family members....after that she gone to court...

Once the Criminal case is dismissed by the way of acquittal or conviction,the surety bonds when can withdrawn from the case dismiss date
after how many days petition 444 can file and take back the money of sureties

My aunty and uncle were co-owners in one property in Maharashtra. My uncle has expired. He have two sons, Mother and wife. In the nomination process my aunt and uncle have nominated their sons. I want to know who would get my uncle's 50 percent property share?
My uncle did not have a will. Please respond immediately.

sir i m working in Indian navy and i made an accident with a child in 2011 inside the naval campus. very next day case handed over to civil police and FIR filed against me by Navy(no member was involved from opponent party)after that i accept my mistake in the special court and court imposed a fine sum of Rs 2500 which i paid and case was closed in the month of Nov 11.Now after almost 3 years the child's father filed a petition in district court for reopening the case.
Sir my query is that ,the child father was not involved earlier for filing a case / FIR against me only Navy was involved.can he approach to next higher court for reopen the case ?
"sir i discussed with a lawyer he told me that who has filed the case against you at starting only he can challenge the verdict of the special court."

Hello,
I am an Indian citizen living in the US and getting married in November to a US Citizen living in the US as well (born in India). The wedding will happen in Nagpur. While my parents still live in Nagpur, her family is in the US.
Given the immigration status and residence location, what is needed to register the marriage in Nagpur after our Hindu ceremony? We will have our passports but not sure if her US Passport and OCI card are acceptable and enough for proof of residence.

This is related to a common passage and thanks to all dear friends , that as per your advice we won the case.
Lower court has given the judgement favouring us that as per easement right i have full right on the common passage. And the wall created by other side needs to be demolished by them from 90 days so that we can use the common passage.Judgement also mentioned that they can appeal to upper court with in 30 days.
So Please advice what needs to be done to protect my self so that this judgement is never dismissed.
Please once again help me to understand what should be my next step.

Hello Respected Members,
Most of you know my False Domestic Violence case. Now District court has ordered to deposit Rs 40000/- and my appeal is admitted.
Before this order court asked my lawyer to file affidavit/proof that no summons were received by me and the case was disposed beyond my knowledge. Fact is that there is no record on part of court that any notice were ever served upon me and practically I did not receive it. I stay far away for last 10 years from my house for occupation. Out of 3 summons (widow mother, me and my brother) one was duly served with my mother in my native place and the other 2 were refused that mother has no connection with her children.
Although we did not get the Order copy as District court is closed due to vacation holidays, perhaps court may hear us and call for lower court record.
My q is
a) As PWDVA is quasi civil in nature, can Civil Procedure Code Order 9 Rule 13 and Order 9 Rule 7
And
b) Rule 6 Sub Rule 5 PWDVA says:The applications under Section 12 shall be dealt with and the orders enforced in the same manner laid down under Section 125 of the Code of Criminal Procedure Code.
Thus it can be safely concluded that Sec.125 and its supporting provisions in CrPC can be used to set aside an exparte order in any case under Protection of Women From Domestic Violence Act. The provision of law should be stated as follows:
Petition filed under Proviso to Sec.126(2) of CrPC read with Rule 6(5) of the Protection of Women from Domestic Violence Rules
Both the interim and final order were decided ex-parte.
c) On hearing can I prove that no domestic violence is done from my side and I have made enough attempt to bring her back by showing evidence like Her Medical Insurance Premium for last consecutive 4 years was taken by me. My phone call records to her parents residence that I was in touch with her. The 2 GDs made in Police Station to show that Domestic Violence has been made by her and not us as she left her matrimonial home on her own to file false case and steal money.
Kindly advice. Waiting for your expert advice.

Can i divorce my husband on ground that he is schizophrenia. I got married 7 years ago and have a 6 years old son. I think my husband had schizophrenia before marriage but it was not visible. They have not told us before marriage. He was running a shop. Then he closed shop and did a job for 1 year with reputed company. He is off and on in his job. Currently, he is not doing any job. I am working since last 2 years and earning around Rs 30 K per month.
I have following questions :
1. Can i get divorce on ground that my husband has schizpphrenia after 7 years of my marriage.
2. Can i claim monthly maintainence from him to support my son. Currently, my father in law is supporting us through rental income.
3. Can my husband claim monthly maintainence from me since i am earning in case i file divorce
4. Can i claim property from my father in law ( his own self aquired property) through my son.
5. Can i file a cheating case against my inlaws and sister in law for not letting us known his problem before marriage.
Will it be useful ?

Family pension claim
Dear Sir,
Who will be the claimant in case of deceased employee who had made nomination in GPF,GIS,& Others to her wife but unintentionally forget to nominate her in Family Pension Nomination Schedule in Service Book. The dependent of deceased had also submit an affidavit for No Objection regarding payment to her mother for Family Pension.
So whether the Succession certificate would be mandate to claim the Family Pension and Gratuity by the claimant.
If not then what procedure to follow in order to claim the Family Pension.
