Huf bank account

We had a bank account in the name of XYZ HUF wherein my husbandwas karta and myself(wife) and my two major-unmarried daugthers were mambers & cooparcenors.
My husbad, as karta, was signatory of the Bank Account.
My husband has expired recently.
I wish to continue the HUF and run it as earlier with myself and my two daughters.
Can we do it, Can we make myself or any of my daughter as Karta and make her saiganatory in Bank Account.Also please tell whether this reconstituted HUF without my late husband, can open a new bank account.
Please guide as I am advised diffrently by different lay people as well as by professionals and we are stuck up.

(i) What is the meaning of a "Circle" under the U.P.Z.A?

(ii) Is it same as 'revenue circle' for which a revenue inspector/kanoongo is an incharge?

(iii) Can a person be allotted 'Gaon Sabha' land in a village which is not part of the 'gaon sabha' (but in the same revenue circle) where the individual resides?

Constitutional law

On an issue of cutting my pension by 6% from 1996, by PRINCIPAL CONTROLLER OF DEFENCE ACCOUNTS (PENSIONS) ALLAHABAD, who incidentally controls Pensions of 2 million ex serviicemen headed by an officer of IA&AS cadre, I received an amazing response reproduced below:

HOWWEVER GRIEVANCE RAISED BY YOU REGARDING INFRACTION OF ARTICLES 14,141,AND 309 OF OUR VENERABLE CONSTITUTION IS BEYOND THE PURVIEW OF THIS OFFICE.

I may please be enlightened with a professional advise, whether it is appropriate and legally an acceptable statement that the Constitution has no role to play in the decisions and orders of THIS OFFICE, WHICH IS PRINCIPAL CONTROLLER OF DEFENCE PENSIONS, ALLAHABAD?

No speaking report was given other than saying that constitutional mandates are not relevant to them.

Break an engagement that has happenned in 2012

Hello Experts

I was in love with a girl for 5+ years and we convinced our parents to get married,engagement happenned in jan 2012 .Here is the real problem after engagement there was incompatibility between both the families,myself and her and decided to seperate by May 2012..Engagement happenned at my place with our expenses...As this is a love marriage proposal NO DOWRY Question here ..Only ring and a new dress have been given to me ....


After that we have decided to get an affidavit -formal paper process to break this contract and return the ring,photos and my distant uncles friend who is a lawyer came to help us with the content..

From 2012 till date girls father used to drag the process everytime asking the content in the affidavit to be changed and we did it several times (nothing but want to delay this whole thing)...

Even we had health problems so 2012,13 and now 14 is passing by...He is always asking that my parents should come and sign the affidavit ...From day 1 he is very stubborn on this..Durig 2012,13 we conveyed the message that if they want signatures they could come to our place and all flight expenses shall be beared by us but they wanted my parents to come to their city and sign ..Also they have spent 20k on engagement expenses and wanted us to return..we are ready to do that as well...

No conversations between the girl and me and also between both the families from the past 2.9 yrs ..

Final Email from the girl to me in 2012:

"I will not come across any of your future engagements or marriages,I also want to get out of this mess ..I will inform the place date and time u can come and give/take the ring...

This situation is so tricky we are not able to read their mind ...Girls father recently spoke to my uncle when we were setting a date and time for getting this affidavits signed and uncle says he spoke very decently and no signs of anger (but who will disclose it on the phone about their actions)...


1) If my parents come Can they be any police sort of action being taken by them?

Please suggest what can be done to solve this

Suggestions from lawyers whom i have met

1) Legal Notice : Cant do that because we want to settle this amicably

2)Disclose the whole thing about this broken Engagement whenever you are planning to look at new alliances...


Experts on this forum Please suggest on how to move forward and settle this amicably :)

Optaining patta in tamil nadu

Is it possible to get patta of a land which belongs to me with proper regd document,,,but the land is in position and been used by some other person ,,when i apply for a patta with the thasildar the person how is using my land comes and gives a objection to the thasildar not to issue a patta because he is in possession of the land for a long period,

so please let me know the law of issuing the patta

Matter of life and death need urgent advice

1. Sir i am from chhattisgarh.my includes my father ,mother a brother sister1 sister2 and myself.

2. We had a property of 40 acres in village out of which out of which 25 acres is in my and my brothers name rest 15 acres lies in my father's name.

3.my father died in 2005 without making any will.according to law it must be divided among class 1 heirs.but even after my fathers dead the 15 acres are even now in my fathers names ,which means that legal distribution haven't took place.

4.after that in 2011 my brother died due to disease and his wife along with his two daughters live with me and also my mother lives with me.

5. So sir my question is .is there any way,"" i am repeating any way""I can get those 15 acres.because my mothers want me have it because my two sisters want their share .also my brother's widow is not sensible as she wants to sell her property without thinking about her daughters.

Please please please answer these its a very serious matter.

And if you have any doubt about the question please ask me I will clear it

Id proof misused

Hello. An unknown person has got a new SIM connection using my name and address and probably ID proof too. He used it to send abusive messages to someone. Now police has asked me about it but they were instantly convinced that I'm not that person. They left and assured me that the culprit will be nabbed soon.

Then I went for registering an FIR but they refused to do that saying its just a small case and will be resolved soon. But I'm worried that I'm still vulnerable in future. What should I do? Should I go to SP office? Will I be able to register an FIR at SP office? How serious the situation is?

Ambiguity about measurement of land

Sir,

Our inlaws have purchased a plot of "L"shaped Land in the year 1991.

In the registered sale deed, the words are read as below ( Translated from Kannada deed);

"As our family is in need ofmoney..... we are now selling 05 guntas of land out of 1.13 ACRE land owned by us.

Subsequently it also given in the schedule as below;

Amidst above said boundaries, 05 guntas consists of -site measuring east to west north side 105 feet x 30 feet,and North to south east side 90 x 40 feet.

The ambiguity here is, whether this should be considered as 05 guntas 1089 x 5 =5445 sq.ft or 3150+3600= 6750 sq.ft.

Now the kins of the deceased land owner is arisising despute & claiming that we are entitled only for 5445 sft and not 6750 sft.

There is a storm water drain towards end of west side and the goverment measurement is not available to us.

Request the experts to kindly guide us in this regard to prove the measurement.
