Discharge petition

The case details are as under I m accused no 2 Fir is lodged against acused no 1 Complainent said that acused no 1 took computers on rent from him and then he did not return the computers And said computers are told to sold to acused no 2 Now Their is no evidence against acused no 2 No computers recovered Our name is nt in fir No evidence of any thing sold to us And more over its in writing by acused no 1 that he doesnt know to whom he has sold the computers Now the publix prosicutor said that in panchnama whixh was done at our ofice the panch said that acused no 2 said we have taken computer and sold to various customers Now how can a punchnama a punch can come to know in 10 minutes we have sold computers to others And also we have never said that we have taken any computers

We has filed discharge aplication in lower court

The aplication is rejected

Now what option we have

Pls sugest us

Case filed under IPC against co-opreative society

Dear all, Pleae advice in following matter-
A urban cooperative credit society (patsanstha) was established under Maharashtra Co-operative Societies Act, 1960. An audit was made under S. 81 of the said Act by the govt. Auditor for the period of 1998-1999 & 1999-2000. After audit, audit report was submitted to registrar and to the concern society. There were some points related to misappropriation of funds and irregularities in record by chairman and employees were raised by auditor. It was expected to give time of 3 months to rectify such defects under S. 82 of the said Act. But the auditor didnot give such time and filed a FIR in police station after 2 days of completion of audit report. Now the stage of case is pending for framing of charges in the JMFC.
Now please suggest on following points-
1) Can the chairman and concern employees give application for discharge under S. 239 of CRPC & will it be fruitful?
2) What would be other remedy available to the accused?
3) Is this matter be regarded as dispute under Mah. Co-operative Soc. Act,1960 and tried by co-operative court?

Paternal land dispute

Sir, My Grandfather was having 4 sons and 3 daughters. He left 20 bigha agriculture land to be divided in his four sons after his death. The partition of land was mutually after his death but now after 7-8 years of his death my elder uncle wants a bigger part and even he is not allowing us to go to our land through his partition, as it is his land. I dont want to do a court case, can we have any other option so that we can handle it leagally.

Regarding ownership rights on sale of property

There is a Joint Ownership Property of Husband and Wife. With mutual consent and settlement, Husband wants to revoke his ownership rights from the property. What husband needs to do, such that Wife can sell the property in his absence or without his consent.

Civil suit- procedure & 7/12 extract (ancestral property)

A legal suit has come up in lower civil court (taluka court) in Maha.state.wherein we 10 are defendants.Queries are:-
(1)Court notices not recd.by no.4&5;whether they shld appear before court;whether 4&5 can still give advocate even before ackg.notices?
(2)1,2,&3 recd.notices but didnt appear on the very first date due to late intimation; can court give ruling "not pr.,hence no say(interest) in matter- pro.ex-parte" (this is what briefed by our advocate)and disallow to present in next date? Is it natural justice? Any rectification procedure?
(3)no.6 to 10 are legal heirs of widow def.no.5, but their names are not in 7/12 extract. (ancestral property)Whether def.6 to 10 can stand to defend their case in court? Is it necessary to include names of 6 to 10 in 7/12 extract as suggested by our advocate?

Filed case using xerox of invalid document

Dear sir
I signed a mutual agreement with my brothers sisters,in presence of panchayat people friends & relatives on march 29, 2013 valid till April 29 2013. In that they agreed that I will acquire my fathers self earned house in turn for which i shall give them portion of my land indvidually.All of us and 7 evidences have signed it .It was only the draft not made in stamp document.The document was not registerd They didnt handover the the home for me as one of my brother had differance of opinion.I too didnt give them the land.The panchayat people said that the document would be cancelled. Now I Have made agreement with a party to sell my land. One of my brother has filed case in court with the xerox copy of the document i made with the family members. The court has numberd the case with an invalid unregisterd xerox copy of the document. How can the court accept it? How should I proceed. The panchayat men have told that they will give me all the cancelled document.My brother has put posters in my village thae my land is in case in the court and no body should buy it. He can put posters without permission from the court or shall i file compensation case?Pls reply me

Sending legal notice

Loan taken in Bangalore by pledging site document. The site is in chennai. Borrower and lender are in Bangalore. Loan taken for 6 months time period. Interest paid is more than 10 times of principle amount. Almost 10 years are over now. For the past 9 months, interest not paid. Now the Lender asking in lakhs for returning the document. Loan taken amount is only Rs.15000. Now to send legal notice, where to approach the lawyer in Chennai or in Bangalore? Request your advice.
