False 498a and other cases

Dear Sir,
my wife file false 498a and crpc 125 in family court. 498a and crpc 125 both stay from high court of Gujarat....
but in DV act 2005 we are attending court hearing at this time my wife failing a false application in nearest police station.. till today she files more then 9 application in different police station in my city, ahmedabad gujarat...
and every application police file false section 151 against me and my parents and hole day from 10 to 5 we are in police station.....

i and my mother complain against this all false application to our city police commissioner but not any action taken by my city police commissioner and when she file false application police is coming my home and treating us because her maternal uncle is a police officer...

my mother try to file complain in metropolitan magistrate but he is not taking our complain ans telling that we have to file complain in police.... my mother tried more then three time but metropolitan magistrate not accepting and he said that this matter not in his power....


please advice me what to do?

if i want to file complaints against my wife in court what i have to do?

please advice me how i can file write petition in high court against police in my city..

please give me any other advice....?

Sale deed and mutation case


Case details :
1. Year 1986 :
Person’ A ‘sold his property to Person ‘B’. Person ‘B’ plotted the land and sold as per plotted scheme to all with valid sale deed and did not file any mutation case.

Out of all land only 200 sqft can’t be sold by ‘B’.

2. Year 1988:
Person ‘C’ purchased from ‘B’. while going for mutation case tahasildar issued Joint patta infavour of ‘C’ and ‘A’ and patta did not shows any clear amount of land belongs to whom i.e what is the amount of land for ‘C’ and ‘A’ on patta but Mutation case of record sheet has figure w.r.t amount of land belongs to ‘C’ and’A’

3. Year 2011:
After getting joint patta, ‘C’ filed another mutation case to separate its name from ‘A’.
‘A’ had given consent and ‘B’ had also given consent to separate patta for ‘A’.
which is not yet finalized for 4yrs.

4. Year 2014:
Mean time ‘A’ expired. And ‘A’ ‘s son sold the said property to ‘D’ by using legal heir certificate of ‘A’ and Joint patta.
5. ‘D’ got patta from tahasil office by giving some money to RI and dealing assistant. As Tahasildar is new to office issued order to give patta and ‘D’ got it.

Under these circumstance what legal remedy should be adopted by ‘C’ for below points :
1. To whom should approach
2. Who has the power to declare sale deed as null and void for ’D’
3. Whether police complaint can be initiated against A’s SON, and under what section.
4. Which approach needs to be followed like administrative or civil proceedings-:
a)Tahasildar -> Sub collector -> Additional district magistrate -> revenue commissioner
b) civil proceedings

5. The tahasildar who ordered patta to ‘D’ is now active in same office, and whether same tahasildar can review his own order and make patta as null and void for ‘D’.

Passrt issue with name

Hi,

My name is Nidhi and I was born in 1991. I am looking to apply new Passport for me with my full name "Nidhi Singh" but I have only first name mentioned in the Birth Certificate(DOB Proof) and only first name mentioned in the Aadhaar Card( Address Proof).
Can you please let me know if I get the Affidavit for name change, I can apply in tatkal. Are News Paper Cutting Mandatory?

Huf property

A person purchases a property during his lifetime out of his income. He declares it as an HUF Karta property. The property purchased stands in his name only.

During his lifetime, he intends to dispose off the property.

Can he sell the property without the permission of his family members?

Division of property

respected sir,
i am living in a half part of property which is about 45 X 55 sft. and the second half is in cover of my brother. the real owner is my mother and she died about 5 years ago. my father also died 2 years ago. i have 4 sisters too. now according to law the whole property should be equaly divide between us but no one of my sisters and brother are wanted to divide it. so my quarries to you that-
1. what can i do for division?
2. any one of them can sell the property if they have papers of property without my signature?
3. what will be the disadvantage of it if the property will not divide for a long time ?
4. can i construct the upper floor over the part of my residence ?

i am requisting to the concerned expert please give me th answer of these quarries.

Writ petition

A writ petition No.19890 of 1999 was filed by the petitioner at Madras High Court against land acquisition in which a judgement was given in favour of the petitioner quashing the land acquisition proceedings in July 2012. In the same reasons, another petitioner filed writ petition No.14164 of 1999 in the same court which was quashed in Nov. 2012 citing the judgement of writ petition No.19890 of 1999 as precedent. Now, the TN Govt. appealed in Supreme court only against the writ petition No.19890 of 1999 and not against the writ petition No.14164 of 1999. Whether results of judgement will affect the judgement of No.14164 of 1999. Kindly clarify.

Consumer forum

District Consumer forum has dismissed my case , I have not received the letter yet from them.I had represented the case myself. Can you please let me know if the next step is to appeal in to State Consumer forum , and what is the procedure. Coming straightforward to the point i'll state that my Father in Law is a Jatt SIkh candidate and has two marriages. My wife is the only daughter from first marriage. From second marriage he has two sons.he lives in chattisgarh.
My mother in law lives here in punjab. in 1995 she purchased a plot in punjab near to her job place( she is a retd. govt. headmistress). later on in 1999(after a house was built on that plot) my father in law forcibly wrote a HIBANAMA from her side and got it registered in local tehsil office, by saying her that its a WILL.That is why he could not produce her at the time of intkal and intkal was not done. she had no knowledge about what is written in that document. in 2013 the made a transfer deed of the same property to her daughter i.e. my wife.. we got the intKal done within 10 days.. we had been in possession of that property after the transfer deed was made. Where do we stand now on legal ground. iS He the valid owner or we...
