Is a order passed by sub divisional magistrate final

Dear All,

Is a order passed by Sub Divisional Magistrate Final ?

There is a shed encroached on a public property. We complained to DC and DC forwarded this to AC and instructed to take action according to CrPc procedure.

AC along with Survey officers, Land records office, Village accountant visited the spot and learned it was clearly an encroachment and causing nuisance to the public. Hearing was done. The owners failed to produce any documents proving ownership of land encroached.

SDM (A.C) has passed orders and instructed the Municipal Commissioner to clear the shed within 15 days of the receipt of the notice. If failed so he would be punished according to the section 188.

My Queries :

1) Is this order passed by Sub Divisional Magistrate final ? What level of powers does a SDM has ?

2) Are there any reasons Municipal Commissioner fail to clear the shed on public road ?

3) Can the hut owners appeal against this order ? If so on what grounds can it be done ?

Rights of mentally ill female in ancestral property.

Respected Sir/Madam,
My cousin's sister is an mentally ill(By birth) aged about 45 years. He is only taking care of her.

Is she has rights in the ancestral property
of my cousin which comes from his father side?

Please advice?

Social torcher by my community

Respected sir , plz help me.i am rinkesh yadav working as a central govt employee.sir I have married to a sc community girl who was styding with me in college.both family was not against the marriage, they supported us and continuesly supporting.but my community (yadav) torcher my family by forcing all others to break the relation with my family..my family live in village which comes under jabalpur district M.P.my community so called heads insulting my family in each social place and boycott my family.they says that nobody make any relation to my family.can I login a FIR against community heads (mukhiya)....plz guide me....

Caviout

Respected Sir/Madam,
I am Prashanth from Karnataka.

Below District Court has ordered the decree in OS(Property litigation-Cash Amount about 1.5 crore and agriculture Land about 5 acres)

Now some people are trying to challenge the decree.
Please inform me in which court should I get Caviout order, Ditrict Court or High Court?

Please suggest me.

Aunt (father's younger brother's wife) is mentally torturing my father

My father has a younger brother. We had moved out of our paternal house a few years back to our own house but had kept the portion of our old house intact and some of our stuff is still lying there. My father visits old home some times to meet my grandfather. Recently, my grandfather had fallen sick. After 10 days in hospital, he got well and went back to old home. Today, my father had gone to visit home and also to bring some stuff from old home to new one. My aunt has put her own stuff like washing machine etc. in our portion but we never complained. Today as my father was opening the doors of our room and was cleaning the floor, She started shouting and hurled abuses on my father. My father is a very calm person. he can't fight and shout loudly, so he heard all that and came back to our new house pretty tensed. Now, he is afraid that if he goes back to old home my aunt will shout again or in worse case can file a FIR against my father in false case(this has happened in my extended family before). So, on one side he wants to visit my grandfather as he cares for him but on another side he is afraid of this thing of shouting by my aunt. Please suggest what should be done in this case. Is there any way to ensure that false case doesn't come on my father?

Respected Sir/Madam,
My wife has lost her memory completely, she is physically and mentally abnormal due to the side effect after outcome of suicide attempt(hanging herself). Now she is living with her parents. My in-laws filed a case against me and case is under trail in court u/s 498(A), 504, 506.
My twin girl childs(4 years) are with my in-laws.

1. How can I take back my wife?

2. My in-laws are asking me to come to their home to live with my wife.
But they are not ready to withdraw the complaint/Case.

Please suggest me.

Probate petition

Probate petition was filed on 11.01.2010 within three years in time. There was delay of 125 days in refiling.The refiling delay was condoned by the court on 15.10.2010.Now what will be the date of filing petition and date of registration.

Directions to state

Case was filed in High Court for directions to State for registration of case as inspite of repeated written requests to SSP/Police as they were not registering case against the party for preparing of false documents in property case but just lingering on one pretext or other to compromise with the party. As I had to come from other state with a distance of 700 kms to & fro and opposite party and Police knowing this would intentionally making me sit from morning to evening at police station and late at evening the opposite party with number of persons would come and speak in loud tone and thereafter also follow me and threat me on-way. Alternatively I approached the High Court for Directions to State/SSP to register case against the party. The high court dismissed application reads as follows :- Learned counsel for the petitioner prays for withdrawal of the present petition to enable the petitioner to approach the learned area judicial magistrate in accordance with law. Dismissed as withdrawn with the liberty aforesaid. My query is that keeping in view danger to my life and long distance of 700 kms I cannot approach local area magistrate as opposite party would be coming to know my presence and there is apprehension that harm could be caused to me. Can I re-appeal in High Court or there alternate way. Please advice.

my birth date is 1.6.1991 i want my birth certificate how can i get it. local authority
means my village accountantsai me that i cannot issue bith certificate to u directly.
