Cibil defaulter

Dear Sir,
In Year between 2006 and 2009 i lend 2 credit cards and 2 personal loans. But i could not repay all on time and i settled out 2 personal loans and one credit card before year 2012.My name was in cibil defaulter list so in 2014 i also paid the waiver amount of 2 loans and one credit card which was given to me as settled discount.
Can you please tell me when my name will be removed from cibil defaulter list , and how i can increase my credit score.

Query regarding unregistered mortagage loan

Dear Sir,

I bought a site in Dilsuknagar, hyderabad in 2012 and started constructing house.

After registration, we noticed land owner put wrong plot nos in the registration document which we did not noticed initially. Later, we got it rectified in Sub registrar office.

Also, Landowner not handed over link documents during registration and replied saying documents lost for a lawyer notice.

After 3 years of struggle, construction work almost completed with remaining 10%. A week ago, Indian overseas bank manager visited our site and told us that land owner has taken 40 Lakhs loan on this property in 2011 and which is unregistered mortgage loan.

This situation made me think it as suspicious due to following reasons; could you please to clear my doubts and advice me the next action to be taken


1) Is bank allowed to give 40 lakhs unregistered loan for a property worth of 30 Lakhs?

2) Is bank can give loan without registering it in sub registrar office?

3) Why bank not taken action against the loan defaulter for 4 years?

4) Is bank allowed to take action against the new owner?

5) Can we continue with our construction work as bank manager told this verbally and without any written notice?

section 498 dowry act

Dear sir, my marriage was solemnised in Dec 1998. My wife went to her parental house in Feb 99. There she joined BTC teachers training without my concern and I brought her back in last week of jun 99. She again went back to her parental house on 01 jul 99. After that she came in Dec 2001 when I served a legal notice to her through my lawyer. (Gap of 2 and half years). Soon after she again left my house blaming that we are not providing her food and other amenities with her father. In Oct 2002 again she came back to my house with her father and three to four persons. Due to my job I was transfered to very far place and left my hometown Agra on 27 Nov 2002. I assured her after arrangement of house I will come back and will take her there a long with me. Again that her father came and took her on 30 Nov 2002. On 02 Jan 2003 she filed section 125 whereas she joined govt job in Dec 99. And again on 14 Jan 99 her father filed a complain case under section 498a, 323, 504, 506 and 3/4 in Aligarh court, Which is now pending in honourable Supreme Court of India.

My query is ...... Whether her father can be main party in filing 498a case against me and my family members. Or is he authorised to file any case related to family disputes once his daughter is well qualified (MA BeD).

Complainant only can file a compliant in police station.

1.On behalf complainant (Lady ) any one of family member can file a complaint in PS.
2.If SHO or station in charge not accepted and not ready to Registered a case what is the alternative way.

Mutual consent

All of U Hi,
She (X) is offered mutual consent she is presently staying in US,They got married in 2009, in India.since 2010.there is No any communication btwn them.Now she is asking consent.
1.Is it compulsory to sent Husband's consent, Even he is not willing.
2.Her advocate compelled him for consent.
3.Is it compulsory to come India for Mutual Divorce.
4 If there is any way for mutual consent.

Seller of house filled one time lease amount, what does it mean?

I recently bought a house, the land was on lease from the Jaipur Development Authority. Around 6 years back, this land (which belonged to the JDA) was under encroachment (kabza), and the government at that time allowed such people to get a legal right on such lands. Then it was converted to a (99 years) leasehold land, which was initiated by the seller. Everything was approved and legal.

2 years back seller paid the one time lease amount and got a certificate. It states that so and so house is free from any lease payment in the future, but the term (like 99 years etc) is not written in it.

The seller claims that this certificate means that the land is VIRTUALLY FREEHOLD, and we don't have to bother about the lease even after the term of 99 years. I am confused about this. I don't seek to take any actions, just for clarification. It didn't affect my judgement for buying the house.

Divorce laws

My dad passed away recently. I am son of his first wife. His second wife died in 2013. Dad again got married through Mumbai marriage beuro and his wife, my second step mom stays in his residence.
Her intentions are to claim heavy maintenance and claim right in property held by my dad.
She keeps on demanding death certificate and marriage certificate.
Her first husband is Dubai resident. He came to sign divorce papers few days before marriage as part of formality demanded by marriage beuro. Now lady has become legal heir of our family and likely to claim her share in whatever is found to be in dad’s name.
What is my obligation towards her? Am I legally bound to give her maintenance? I doubt her first marriage separation to be of legal validity. She is found to be having valid Dubai visa expiring in 2016.
Can I demand following documents from her to prove legal status?
1) Indian court divorce decree.
2) Her immigration documents.
3) Any of the formalities needed to be followed before marriage as suggested by lawyers.
If she fails to produce can I proceed to prove her marriage illegal and strip her of any rights she is likely to claim?

Should I accept beuro’s marriage certificate signed present of lawyers to be of genuine and accept her as legal heir.

Sincerely seek Expert’s guidance in this regard.
